TERMS OF USE
The undersigned member of the Alliance for Water Efficiency (AWE) agrees to the following Terms of Use for free use of the AWE Sales Forecasting and Rate Model (Model):
1. The undersigned member ensures their AWE membership is current, including payment of dues.
2. The undersigned member agrees not to share the Model (or corresponding documents, e.g., User Guide) with any other party.
3. The undersigned member agrees not to post any Model results on any website unless converted to Adobe Portable Document Format (.pdf) file format or as an image file (.gif, .jpg, .png).
4. The undersigned member agrees to provide credit to AWE whenever the Model results are published or presented.
5. The undersigned member agrees not to use the Model for client analysis unless the client is also a current member of AWE in good standing.
6. The undersigned member agrees not to provide the Model (or corresponding documents, e.g., User Guide) to a consultant or other party conducting an analysis on its
behalf unless they are a current member of AWE in good standing.
7. The undersigned member agrees to release AWE, its officers, agents, and employees from liability for
any claims or damages of any kind or description that may arise from use of the Model.
In return, AWE agrees to the following:
1. To provide the Model and User Guide upon signed acceptance and receipt of these Terms of Use; and
2. To automatically provide version updates (as applicable) of the Model and User Guide, provided the
undersigned member’s membership status is in good standing.
Both users and beneficiaries of the Model must be current members. Using or benefitting from the Model as a non-member is a violation of these terms and constitutes misuse.
AWE reserves the right to enforce
the membership requirement for non-members using or benefitting from the Model in order to rectify this type of misuse. Membership requires payment of annual dues.
Below is an example of appropriate use and an example of misuse to help you ensure you are adhering to the above terms.
The example uses a fictitious water utility named Utility XYZ and a fictitious consulting firm named Consulting Firm ABC.
Appropriate use looks like this
- Both Utility XYZ and Consulting Firm ABC are members of AWE. Utility XYZ hires consulting firm ABC to conduct a rates review and intends to use the Model. This is appropriate use because both the user and the beneficiary are AWE members.
Unacceptable use looks like this
- Utility XYZ hires Consulting Firm ABC to conduct a rates review and intends to use the Model. Utility XYZ is a member of AWE and obtains a copy of the Model. Consulting firm ABC is not a member of AWE. Utility XYZ provides a copy of the Model to consulting firm ABC. This is a violation of the Terms of
Use. (It is also a violation of the Terms of Use if a consulting firm provides analysis using the Model for a water utility that is not an AWE member in good standing.)
